Special counsel says holding Trump's classified docs trial before election would not violate DOJ policy

Judge Aileen CannonAn attorney with the special counsel Jack Smith's team told a judge Friday that holding former President Donald Trump's classified documents trial before the November election would not violate Justice Department policy.

U.S. District Judge Aileen Cannon is hearing arguments today on moving the May 20 trial date in Trump's federal classified documents case during a court conference in Florida that the former president is attending in person.

Special counsel Prosecutor Jay Bratt pushed for a July start, saying that holding a trial within 60 days of an election would not violate the Justice Department's typical aversion to bringing politically charged cases so close to an election.

Bratt told Judge Cannon a trial is permissible because the policy does not apply to already indicted matters.

"We are in full compliance with the Justice Department manual," said Bratt.

Infowars host Owen Shroyer gets 2 months in prison in Capitol insurrection case

Own Shroyer gets two months sentenceInfowars host Owen Shroyer was sentenced on Tuesday to two months behind bars for joining the mob’s riot at the U.S. Capitol, which prosecutors said he “helped create” by spewing violent rhetoric and spreading baseless claims of election fraud to hundreds of thousands of viewers.

Shroyer hosts a daily show called “The War Room With Owen Shroyer” for the website operated by conspiracy theorist Alex Jones. Prosecutors said Shroyer used his online platform — and later a megaphone outside the Capitol on Jan. 6, 2021 — to amplify lies that Democrats stole the 2020 presidential election from Donald Trump, who was the Republican incumbent.

Shroyer didn’t enter the Capitol, but he led a march to the building and led rioters in chants near the top of the building’s steps. He’s among only a few people charged in the riot who neither went inside the building nor were accused of engaging in violence or destruction.

Florida Resort Abruptly Cancels Marjorie Taylor Green’s Jan. 6 Event

A Florida resort scheduled to host Rep. Marjorie Taylor Greene (R-Ga.) for what organizers claimed would be a small book signing abruptly canceled it Thursday after learning the gathering was actually meant to commemorate the third anniversary of the deadly Jan. 6, 2021, attack on the U.S. Capitol.

Westgate Resorts’ Kissimmee, Florida, location said the Osceola Republican Party made no mention of Jan. 6 when they pitched the event, instead describing it as a book signing for Greene’s memoir.

“Please be advised that Westgate was not made aware of the purpose of this event when we were approached to host a book signing,” the resort said in a statement. “This event has been cancelled and is no longer taking place at our resort.”

Despite the cancellation, the Osceola County Republican Party was still selling tickets to the event as of Friday morning.

Scott Perry Needs To Hand In Thousands Of Phone Records To Special Counsel, Judge Rules

Scott PerryA judge on Tuesday ordered Rep. Scott Perry (R-Pa.) to turn over close to 1,700 records from his personal cell phone to special counsel Jack Smith as part of the Justice Department’s investigation into efforts to overturn the 2020 presidential election.

In a 12-page ruling, Chief U.S. District Judge James E. Boasberg said only 396 of 2,055 records in question from Perry’s phone were privileged under the Speech or Debate Clause of the U.S. Constitution, requiring Perry to hand in the rest.

Appeals court to Trump: No presidential immunity in E. Jean Carroll defamation suit

Trump has no immunity in EJ Carroll law suit

Donald Trump can't point to his time in the White House in an effort to duck a civil defamation lawsuit tied to sexual assault allegations because he waited too long to claim presidential immunity, an appeals court ruled Wednesday.

The case concerns Trump's denial in 2019, while he was president, of having sexually assaulted journalist and advice columnist E. Jean Carroll in the mid-1990s. In June of that year, Trump described Carroll as “a woman who has also accused other men of things," and called her account "a totally false accusation."

In a separate civil case, Trump was ordered in May to pay Carroll $5 million after a jury found both that he sexually abused her, and had defamed her through a 2022 statement denying the assault. Trump has appealed that verdict.

Florida drag shows win termporary stay

The U.S. Supreme Court refused Thursday to reinstate a Florida law that punishes businesses for allowing children into drag shows.

Florida Gov. Ron DeSantis signed into law the "Protection of Children Act" in May to ban "children" from any "adult live performances" that feature sexual or lewd conduct. The penalty for restaurants or other venues that violate the statute is potential license revocation or even criminal charges. While the law does not explicitly refer to drag shows, it is widely seen as aimed at them.

Hamburger Mary's Restaurant and Bar in Orlando, Fla., challenged the law in court, contending that it violates the First Amendment right of free speech. The restaurant frequently hosts drag show performances, comedy sketches, and dancing. In July a federal judge in Florida temporarily blocked the law from going into effect, and the state of Florida asked the Supreme Court to reinstate it while appeals are carried out in the lower courts.
